1. General Terms
▪︎If your personal Terms of Use invalidates any rule found in this document, or makes a statement that it “voids” my entire Terms and Conditions, do not contact me for commissions.
▫︎That being said, this is a declaration that my terms of use overrules any conflicting terms in the buyer's personal Terms of
Use regarding my artwork and designs.
▪︎Inappropriate messages at anytime will not be tolerated, and will automatically cancel the commission process.
▪︎Guilt tripping or harassment towards myself or others will not be tolerated.
▪︎You may change anything you want about the adoptable once payment is received.
▪︎As a courtesy, please do not resell my designs for more than you initially paid for.
▫︎If you've added commissioned artwork, the price should reflect the total amount paid for the design and art.
▫︎This rule trickles down to future owners
▪︎Accepted offers are listed on the batch post, or in the profiles on ToyHouse.
2. TOYHOU.SE TERMS
▪︎A maximum of three (3) characters will be sent to a single user, unless an adoption purge is in session.
▫︎This is to prevent a slew of designs being sent to never be used.
▪︎Do not change the designer / creator links
▫︎Unless it is to credit an unknown artist
▪︎Please do not edit the artists link in the images
▪︎Attempts to change creator and or designer credits to work around my Terms of Use is a reportable offense & will result in black listing. This includes:
▫︎Requesting designer / creator changes
▫︎Deleting the original profile, and remaking it to exclude my credits
3. COPYRIGHT & USAGE
▪︎As the artist, I retain the copyright of my artwork
▫︎I reserve the right to repost & showcase any art I create.
▪︎My designs are allowed for commercial use, but my artwork is not
▫︎You may make comics, shows, games and merchandise using my designs after payment is received
▪︎My artwork still requires credit if it is reposted elsewhere
▫︎Credit must always remain, wether commercial rights were obtained or not.
▫︎Credit in the form of text ("Artist - Ksureme"), tag ("Artist: @Ksureme"), or link (Artist: bit.do/Ksureme") is acceptable.
▫︎My watermarks are not to be removed or covered up
▪︎Kinning with or using my designs as personas is allowed!
4. PAYMENT
▪︎I will not accept payments of the following:
▫︎Exposure / Shoutouts / Credit Only
▫︎Prayers / Vibes / Good Thoughts
▫︎Delayed Payment
▫︎Nude photos
▫︎eChecks or checks by mail
▪︎I accept payments only through PayPal in USD ($) or with DeviantArt points (DP)
▫︎1 USD = 100 DP
▪︎I will send out invoices for the adopters to pay if they are paying through PayPal
▫︎DeviantArt adopters will send the points over through this link
“Agreeing to the document also means that you acknowledge the consequences of breaking this contract”
By having the adoption code obtainable through an “I Agree” clickwrap, it is a legal online agreement that you've read and agree to the terms and conditions that apply to my adoption process. Understand that I am a human first, and artist second. Punishable offences include, but are not limited to dehumanizing conversation, poor treatment towards me, sexualizing or objectifying me or continued uncomfortable conversation after being told to stop. I will send a courtesy message explaining what led to the cancellation and any other action. Penalties include adoption cancellations, blacklisting, and a seller / artist beware post. The refusal of refunds is only applicable if the commission experience is incredibly deplorable due to the commissioner's behavior. As a protective measure, I have the right to retain screenshots of the commission conversation to use as evidence or to clear up untruthful claims. All sales are final.
